Origin Bulk Grape Requirements

Exhibit A

  1. Responsibilities of growers are:
    1. The grower shall allow the Agricultural Commissioner onto the premises to monitor compliance of this agreement.
    2. Grower shall immediately notify the Agricultural Commissioner of any GWSS detected in the vineyard.
    3. The grower shall notify the Agricultural Commissioner no later than 72 hours prior to harvest of their intent to ship bulk grapes.
    4. The grower shall assure that a compliance certificate tag will accompany all bulk grape shipments from counties with an infested area and the compliance certification tag shall be given to the processor.
    5. The grower shall inform the destination Agricultural Commissioner of any diverted bulk grape shipments, including its final disposition.
  2. Growers shall ensure that compliance certificate tags are used in the following manner:
  3. Compliance certificate tags are not required on bulk grape shipments originating from counties, which have completed their initial survey for the GWSS, and the county contains no infested areas.
    1. Compliance certificate tags shall accompany all bulk grape shipments from counties with an infested area.
    2. Compliance certificate tags shall accompany bulk grape shipments from counties that have not completed their initial surveys for GWSS.
    3. Green-punched compliance certification tags shall be issued for bulk grape shipments originating from vineyards located in the non-infested area of a county with an infested area based upon the Agricultural Commissioner's initial survey.
    4. Grower shall retain the grower's copy of the compliance certification tag.
    5. Yellow-punched compliance certification tags shall accompany all bulk grape shipments from the infested area of a county when the vineyard is found free from the GWSS based upon trapping and visual surveys by the Agricultural Commissioner.
    6. Yellow-punched compliance certification tags shall accompany bulk grape shipments when originating from vineyards within infested areas that are treated prior to harvest with an approved pesticide.
    7. Yellow-punched compliance certification tags shall accompany bulk grape shipments when originating from vineyards within infested areas that are destined to a cold treatment facility.
    8. When by mutual agreement, the origin and destination Agricultural Commissioner's determine that neither free-from nor treatment protocols apply, the shipment from an infested area may move under the following conditions:
      1. The receiving processing facility is operating under a valid compliance agreement.
      2. Grape plant material not secured in the bin or gondola must be removed from the vehicle prior to departure.
      3. The shipment is moved directly to the processing facility without undue delay or diversion immediately following harvest.
      4. The grapes are processed as soon as possible after arrival.
      5. The yellow-punched compliance certification tag shall accompany the shipment.
    9. The compliance certificate tag shall remain with the assigned bulk grape shipment from origin to destination.
